The study of Krisztina Nagy argues that in the present information and media environment only an increased role of the state can guarantee the rights of the child, the right to education and the freedom of expression. Focusing primarily on the latter, the author concludes that media pluralism requires not only diversity of sources and diversity of content, but also the diversity of exposure or use. Competencies to access information, critical thinking and the need to be informed from multiple sources are preconditions of media pluralism. This, from a fundamental rights' perspective, legitimates the state's active role in the development of media literacy.

The study of Zsolt Ződi investigates the different aspects of the Big Data phenomenon from a fundamental rights perspective, focusing primarily on the protection of personal data. The author discusses the definition of the Big Data phenomenon in depth before identifying and analyzing eight areas where this phenomenon gives rise to serious challenges to the human rights regime: overproduction of data, the lack of clarity of the regulation, profiling, automated decision-making, re-identification, discriminative practices, automated prediction and nudging. Finally, the article ends with the critical analysis of the relevant EU legislation.

Forum

Antal Attila argues that there could and should be a type of populism that can contribute to strengthening the European identity against nationalist right-wing populism. Balázs Majtényi focuses on the relationship between constitution and society, namely how the popular perception of identity and values can impact on constitutional democracy and its institutions, and how the reformulation of national identities can endanger the European project and constitutional democracy itself. Anita Rozália Nagy-Nádasdi and Barbara Kőhalmi assess the question whether in the infringement procedure started because of Hungary's non-compliance with the European Council's relocation plan, the country can successfully excuse itself by reference to its constitutional identity.
